به گزارش روز دوشنبه خبرنگار فرهنگی ایرنا از مركز روابط عمومی وزارت فرهنگ و ارشاد اسلامی ، هیات رسیدگی به امور مراكز فرهنگی در آخرین نشست خود بررسی مجدد صلاحیت خانه سینما را در دستور كار قرار داد و در نهایت پس از بررسی همه جانبه فعالیت و ملاحظه كلیه اسناد و مدارك ، این تشكل را فاقد هرگونه وجاهت قانونی دانست.

بنابراین گزارش ، جلسه هیات رسیدگی به امور مراكز فرهنگی با توجه به دادنامه شعبه اول دیوان عدالت اداری كه صلاحیت رسیدگی به وضعیت تشكل موسوم به خانه سینما را منوط به بررسی و اعلام نظر قطعی این هیأت دانسته است، تشكیل شد.

اعضای هیأت باتوجه به تمامی مفاد دادنامه یادشده و با استناد به مواد 15، 17 و 20 ضوابط و مقررات تأسیس مراكز، موسسات، كانون ها و انجمن های فرهنگی هنری و نظارت بر فعالیت آنها مصوبه جلسه 385 شورای عالی انقلاب فرهنگی مورخ 27 شهریور سال 57 رای نهایی خود مبنی بر تعطیلی دائم خانه سینما را اعلام كردند.

بر اساس بند ( ب ) صورتجلسه با عنوان بررسی وضعیت تشكل موسوم به خانه سینما , اعضای هیات , بنا به دلایل زیر، ادامه فعالیت این تشكل را غیرقانونی اعلام كردند:

1-ب: به استناد تبصره ماده 10 و ماده 22 مصوبه جلسه 385 شورای عالی انقلاب فرهنگی، اساسنامه آن تشكل تاكنون به هیأت رسیدگی به امور مراكز فرهنگی و هنری برای بررسی و تصویب ارایه نشده است.

2-ب: تغییرات پی‌درپی در اساسنامه ادعایی تشكل موسوم خانه سینما جهت تأیید به شورای فرهنگ عمومی منعكس نشده است.ضمن اینكه با تصویب مصوبه جلسه 385 شورای عالی انقلاب فرهنگی درسال 75 وظیفه بررسی وتصویب اساسنامه ها از شورای فرهنگ عمومی به این هیأت انتقال یافته است.

3-ب: طبق بند ج ماده 10 و تبصره ماده 11 مصوبه جلسه 77 شورای عالی انقلاب فرهنگی (سال 67) صدور مجوز اینگونه مراكز به ترتیب از 'وظایف هیأت نظارت وقت' و 'وزیر فرهنگ و ارشاد اسلامی' بوده و معاون وقت امور سینمایی و سمعی و بصری فاقد تنقیذ حق وزیر بوده است و بنابراین نامه ارسالی آقای انوار به اداره كل ثبت شركت‌ها به استناد ماده 15 مصوبه جلسه 77 شورای عالی انقلاب فرهنگی به‌منزله صدور مجوز تأسیس خانه سینما نیست. ضمن اینكه اساسنامه ارسالی به اداره كل ثبت شركت ها مورد تأیید شورای فرهنگ عمومی نیز نمی‌باشد.

4-ب: تشكل موسوم به خانه سینما هیچ‌گونه اقدامی در جهت تطبیق وضع خود با ضوابط و مقررات مندرج در ماده 20 مصوبه جلسه 385 شورای عالی انقلاب فرهنگی (سال 1375) نكرده است و حتی مدارك لازم به همراه اساسنامه جدید طبق ضوابط و شرایط مندرج در ماده 6 این مصوبه را جهت تأیید و صدور مجوز جدید به هیأت تسلیم ننموده است.

ناظر ویژه دادستان با بیان اینكه این فرد با معدل 42/10 از دبیرستان دیپلم گرفت، ادامه داد‌: این متهم در سال 1373 در رشته عمران دانشگاه آزاد اسلامی واحد زنجان پذیرفته می شود كه در طول شش ترم تحصیل خود در سه ترم مشروط و نهایتا با معدل 23/6 از این دانشگاه اخراج شده است.

تورج ادامه داد: این فرد پس از سال 1381 كه به امر چوبداری و خرید و فروش احشام در كرج و حومه آن مشغول بوده و در زیر زمینی در این شهر زندگی می كرد.

وی تصریح كرد: این متهم پس از آشنایی با فرماندار یكی از شهرستان های شمالی و رییس بانك آن، آب معدنی داماش را تاسیس می كند كه به علت سوءمدیریت 80 چك آن برگشت خورد.

ناظر ویژه دادستان با بیان اینكه این گروه با نفوذ در مسوولان ملی و محلی به شیوه های مختلف آنها را تطمیع می كردند، افزود: متهم و برادرانش و دستیاران او به لحاظ ارتباطات گروهی ذی نفوذ، باب سوءاستفاده و فساد را در پیش گرفتند.

تورج با اشاره به زندگی مجلل این متهم خاطر نشان كرد زندگی طاغوت گونه ایشان نظیر ندارد.

وی به خدمت گرفتن پیش خدمت از كشورهای خارجی، خرید 10 میلیاردی جواهرات برای همسران متهم، تامین بهترین امكانات برای زندگی افراد این خانواده و در اختیار گرفتن بالگرد در كشورهای آسیایی را نمونه ای از زندگی اشرافی گری این متهم اعلام كرد و گفت: این در حالی است كه این متهم وقتی از هتل پنج ستاره محل اقامت خود در فرانسه راضی نبود به صورت تلفنی دستور بركناری یكی از خانم های كارمند خود را كه مسوول رفاه شخصی او بود، داده است.

وی با بیان اینكه این متهم اصلا علاقه ای حتی به تماشای فوتبال نداشته است، گفت: این متهم سه تیم ورزشی فوتبال تاسیس كرده كه معلوم نیست هدف او از این اقدام چه بوده است.

تورج با بیان اینكه از سال 1388 تا سال 1390، 53 هزار میلیارد ریال به نفع شركت های گروه آریا گشایش اعتبار شده است، تصریح كرد این در حالی است كه این گروه به شبكه بانكی، سه هزار و 500 میلیارد تومان بدهی دارد.

وی ادامه داد: ساده انگاری است كه كاركرد این گروه را كاركردی سالم و بدور از فساد بدانیم، اگر صورت اقدامات آنها كاملا شفاف و بدور از فساد بود چگونه فردی در كمتر از یك دهه از چوبداری به قطب اقتصادی رسیده است.

ناظر ویژه دادستان با بیان اینكه وكلای این متهم معتقدند وی فردی كارآفرین بوده است، گفت: برخلاف آنچه گفته می شود در 48 شركت فعال این گروه، نزدیك به 16 هزار كارگر كار می كنند كه از این 16 هزار، 14 هزار كارگر متعلق به چهار شركت بزرگ دولتی اكسین، ماشین سازی لرستان، فولاد خراسان و ابنیه وزارت راه و ترابری است كه به این گروه واگذار شده است اما این گروه در فولاد خوزستان 800 نفر را اخراج كرده كه نشان می دهد این گروه نه تنها كارآفرین نبوده بلكه به تعهدات خود مبنی بر اخراج نكردن كارگران پایبند نبوده است.

تورج ادامه داد: این گروه قصد داشت در امور زیربنایی، صنایع غذایی، پلیمر، صنایع ساختمانی، فلزی، دامداری، حمل و نقل و خرید اسكله و كشتی در حمل و نقل دریایی فعالیت های خود را گسترش دهد كه با توجه به گسترش فعالیت آنها معلوم نبود چه تبعات سیاسی امنیتی از سوی این گروه برای كشور ایجاد شود.
